HARRISBURG – Legislation that would correct a loophole in the law dealing with instances of individuals fleeing from a police officer was passed by the House today, according to the author, Rep. Mike Regan (R-York/Cumberland). Current law does not address situations in which a person is pulled over and then flees on foot.
“This bill is necessary because it is currently not a criminal offense for a driver to flee or elude a police officer after the signal is given to stop the vehicle,” said Regan. “This loophole has been in need of correction for some time and this legislation would accomplish that.”
Regan said
House Bill 220 would require a person who has been ordered to pull his/her vehicle over to not only stop, but remain in the vehicle.
Regan, a former law enforcement official, said this will not only protect the officer making the traffic stop, but the public as well, when a fleeing suspected offender could potentially endanger the community at large. The penalty for such a crime would be identical to that of failing to stop a vehicle.
The bill goes to the Senate for consideration.
