Reichard Bill to Protect Children, Strengthen Police Response to Indecent Exposure

WAYNESBORO – Sparked by a reported indecent exposure incident in a Washington Township park, Rep. Chad Reichard (R-Franklin) will soon introduce legislation granting police the power to make an on-scene arrest during such cases.

Under current Pennsylvania law, police must witness indecent exposures firsthand to make an on-scene arrest without a warrant.

“I was astonished to learn from police that an on-scene arrest couldn’t be made when a man was seen by others exposing himself near a park where children play,” Reichard said. “I quickly got to work to right this wrong and a bill to fix this issue will soon be introduced.”

According to Washington Township Police, officers responded to Red Run Park for a reported indecent exposure incident. Though police gathered enough information indicating an alleged crime took place near the playground area, and officers deemed the offense met the level of a misdemeanor, officers could not make an on-scene arrest since they did not personally witness the act. Charges have since been filed.

Reichard’s forthcoming legislation would establish an exception for indecent exposure, allowing an officer to make an on-scene arrest when the officer has probable cause to believe the offense has been committed.

State law already provides for warrantless arrests for certain misdemeanors, including offenses such as scattering rubbish. This legislation would similarly give police the authority to respond promptly and appropriately to allegations of indecent exposure.

“Parents should be able to take their children to a local park without worrying that someone who exposes themselves can simply walk away because an officer didn’t happen to witness the act,” Reichard said. “Our police officers need the tools and authority to protect our communities. This legislation will help ensure they can take action when there is probable cause that an indecent exposure has occurred.”
